What is Personal Injury and how is it calculated?

Personal injury is the harm to a person's psycho-physical integrity, assessable by a medico-legal expert. To calculate its economic value, the Tables prepared by the Courts are used (in particular those of the Milan Court, valid in almost all of Italy). The calculation assigns an economic value to each percentage point of disability (from 1 to 100), crossing it with the age of the injured party at the time of the accident.

What does "differential damage" mean (e.g., INAIL)?

In the case of a workplace accident, INAIL provides an indemnity to the worker. However, the INAIL indemnity does not cover the entire damage (for example, it does not cover moral damage or only partially covers personal injury). The "differential damage" is the compensation quota that you can request from the civilly liable party (or the employer) to obtain full reparation for the damage suffered, subtracting what has already been paid by INAIL.

How much time do I have to claim compensation?

In extra-contractual liability (e.g., an accident, a fall on a public road), the right to claim damages expires in 5 years from the day the event occurred. However, if the event is also considered a criminal offense, the civil statute of limitations adapts to the (often longer) term provided for the crime itself.
