Terms and Conditions of use.

Read before using the service. CalcuLegal is a free informative tool. Its use implies the acceptance of these terms, which define what the service is, what it is not, and the limits of the operator's liability.

Definitions
Basic Glossary

For the purposes of these Terms, the following definitions apply:

Service — the CalcuLegal web platform, accessible at www.calculegal.it, including all calculators, the Reputation Radar, and legal orientation tools.
Operator — Artur Arkadiusz Woszczyk, owner and manager of the Service.
User — any natural person who accesses the Service and uses its features, regardless of whether they have provided identifying data.
Estimate — the calculation result produced by the calculators, expressed as an orientative and preliminary value of the main damage items applicable to the case described by the user.
Partner Firm — the law firm registered with the Bar Association with which the Operator has stipulated a collaboration agreement for the orientation service upon user request.
File — the encrypted package of identifying data that the user transmits to the Partner Firm upon explicit consent at the end of the simulation.

Nature and limits of the Service
Legal Warning

CalcuLegal is an automated informative service. It is not a law firm, it is not a lawyer, it is not a legal consultant, it is not an expert, and it is not a professional intermediary under Law December 31, 2012, no. 247 (Forensic Professional Law).

Fundamental limit — The Estimate produced by the calculators is orientative, preliminary, and non-binding. It does not constitute legal advice, professional consultation, technical appraisal, or defensive activity. It cannot be produced in court as evidentiary documentation. Its reliability depends on the completeness and truthfulness of the data entered by the user.

The Service does not assess the legal merits of the user's compensation claim, does not estimate the probability of success of a potential proceeding, and does not recommend specific judicial or extrajudicial strategies. For any binding evaluation, it is necessary to consult a lawyer registered with the Bar Association.

Access and conditions of use
Rules of use

The Service is accessible free of charge, without registration, and without usage limits for the simulation features. Access is permitted to any natural person who has the legal capacity to act.

The user agrees to use the Service properly and in good faith, entering data that is as complete and truthful as possible, knowing that the quality of the Estimate depends directly on the quality of the information provided.

Prohibited uses
Use of the Service for fraudulent purposes, procedural abuse, or the production of false documentation.
Attempting reverse engineering, automated scraping, or systematic extraction of the calculation algorithms.
Using the Estimate as an official document, appraisal, or legal opinion in any judicial or extrajudicial setting.
Representing the Estimate as a professional evaluation coming from a lawyer or an expert registered in a professional roll.
Use of the Service by persons acting on behalf of third parties without adequate authorization.

Free nature of the Service
Economic transparency

The simulation is and will remain completely free for the user in all its components: calculators, Reputation Radar, and estimate reports. No registration is required, neither now nor in the future. A paid version of the simulation Service does not and will not exist.

Declaration of permanent free access — Being free is not a temporary promotion. It is a definitive design choice motivated by the informative and public utility nature of the tool. Any future variation will be communicated at least 60 days in advance.

The Operator covers the costs of the Service through contractual agreements with Partner Firms. These agreements provide for a fixed periodic fee payable by the firms, not linked to the number of files generated or their outcome. The Operator does not receive percentages on lawyers' fees or on compensations obtained by users.

Legal orientation service
Contact rules

At the end of the simulation, the user can choose to be put in contact with a Partner Firm. This feature is optional and is activated exclusively upon the explicit request of the user, via informed consent with a double opt-in.

The Operator transmits the File to the Partner Firm within the technical times necessary for encryption and routing.
The Partner Firm commits to providing an initial response to the user within 24 working hours of receiving the File.
In case of failure to respond within the deadline, the Operator automatically reassigns the File to another available Partner Firm.
From the moment of the first contact between the Partner Firm and the user, the professional relationship is exclusively between the two parties. The Operator does not participate, intervene, or have access to subsequent elements of the case.
Professional Independence The lawyer of the Partner Firm operates in full professional autonomy in compliance with the Forensic Deontological Code. The Operator does not influence, direct, or supervise the professional evaluations and decisions of the lawyer.

Intellectual property
Law 633/1941

All contents of the Service — calculation algorithms, methodology for translating tabular parameters into computational logic, texts, graphics, design, and source code — are the exclusive intellectual property of the Operator or its licensors and are protected by copyright law (Law 633/1941) and industrial property rules.

The reproduction, even partial, of the calculation algorithms or the proprietary methodology without written authorization from the Operator is prohibited.
The use of the CalcuLegal name, logo, and trademark for unauthorized services, products, or communications is prohibited.
The user retains full ownership of the data entered into the Service. The Operator does not claim any rights over the user's personal data.

Limitation of liability
Leg. Decree 70/2003

The Operator is not responsible for the decisions made by the user based on the Estimate produced by the Service. The Estimate is a preliminary orientation tool: the decision to take or not take legal action, and in what way, rests exclusively with the user, preferably after consulting a lawyer registered with the Bar Association.

Disclaimer of liability — The Operator is not liable for direct or indirect damages arising from: inaccuracy of the Estimate due to incomplete or incorrect entered data; failure to comply with limitation periods not promptly signaled by a professional; judicial or extrajudicial decisions based exclusively on the Estimate; any interruptions or technical malfunctions of the Service.

Pursuant to Leg. Decree 70/2003 (implementation of Directive 2000/31/EC on electronic commerce), the Operator is exempt from liability for the content transmitted or stored at the user's request, within the limits and conditions provided by current legislation.

Processing of personal data
Privacy and Cookies

The processing of personal data is governed by CalcuLegal's Privacy Policy, which forms an integral part of these Terms. The user is invited to read it before using the Service.

In summary: the simulation phase is completely anonymous and does not require identifying data. Any transmission of data to the Partner Firm occurs exclusively upon the user's explicit consent, with AES-GCM 256 bit encryption and exclusive access to the receiving professional via RSA-OAEP 4096 bit key and MFA authentication.

Zero profiling — CalcuLegal does not use profiling cookies, does not transfer data to third parties for marketing purposes, and does not track user behavior for advertising purposes.

Changes to the Service and Terms
Updates

The Operator reserves the right to modify, update, or integrate the Service at any time, including in response to regulatory, tabular, or jurisprudential changes. Modifications to calculation parameters do not constitute a contractual variation subject to acceptance.

Changes to these Terms will be communicated to registered users via email and published on this page at least 30 days in advance of their effective date, except for urgent modifications imposed by regulatory changes.

The current version of the Terms is always the one published on this page with the date of the last update indicated at the bottom of the document. Continued use of the Service after the changes take effect constitutes acceptance of the same.

Applicable law and jurisdiction
Jurisdiction

These Terms are governed by Italian law. For any dispute regarding the interpretation, execution, or termination of these Terms, the Court of Milan shall have exclusive jurisdiction, subject to any mandatory legal provisions for the protection of consumers.

Alternative Dispute Resolution (ADR/ODR) For disputes with consumers, the Operator adheres to alternative dispute resolution procedures pursuant to Leg. Decree 130/2015 and EU Regulation 524/2013. The European Commission's ODR platform is accessible at ec.europa.eu/consumers/odr.
